11.1 INTRODUCTION
The following terms and conditions constitute the Terms of Use Agreement (“the Agreement”) between you (the “Customer”) and The Medical Concierge Group together with its affiliated companies (the “Company”), concerning your access to and use of the Company’s services, clinic, website, as well as any other media forms, media channels, mobile websites, or mobile applications related or connected thereto. Supplemental terms and conditions or documents that may be posted on the Website from time to time, are hereby expressly incorporated into this Agreement by reference.
This Agreement constitutes a legally binding agreement between you and the Company and governs your use of the services offered by the Company and your use of the clinic. Please take the time to read and understand our Data protection and Privacy Policy. By using the services offered by the Company and by using the clinic you confirm that you agree to comply with and be bound by all the terms and conditions contained in this Agreement and with the Company’s personal data practices described in the Data protection and Privacy Policy.
YOU ACCEPT AND AGREE TO BE BOUND BY THIS AGREEMENT BY ACKNOWLEDGING SUCH ACCEPTANCE DURING THE REGISTRATION PROCESS (IF APPLICABLE) AND ALSO BY CONTINUING TO USE THE WEBSITE. IF YOU DO NOT AGREE TO ABIDE BY THIS AGREEMENT, OR TO THE MODIFICATIONS THAT THE COMPANY MAY MAKE TO THIS AGREEMENT IN THE FUTURE, DO NOT USE OR ACCESS OR CONTINUE TO USE OR ACCESS THE COMPANY SERVICES OR THE WEBSITE.

11.3 SCOPE
Rocket Health clinic offers a wide range of medical services that include;
- Medical Consultation
- Physical assessment including technology enabled eye and ear examination, skin examination, mouth exam, Blood Pressure check-up, pulse oximetry
- Antenatal care
- Family Planning services
- Laboratory sample collection services
- Prescriptions filling
- Travel vaccinations
- Nutritional counselling
- Pre-marital check-up
- Back to school medical exam and form completion
- Pre-employment medical assessments
- Foreign travel heath checks, vaccinations and medicines
- Minor surgeries like wound dressing, incision & drainage, medical male circumcision, corn removal, foreign body removal from ear/nose/eyes etc.
- We also offer health care packages for patients with chronic illness, notable hypertension and diabetes
The clinic does not handle cases of medical/surgical emergencies and if you require emergency medical assistance you should go directly to the nearest hospital emergency room.
11.4 PROCEDURE
Once you have made contact with the Rocket Health Clinic, you will be asked to provide certain information, to enable us to book an appointment for you based on your location, language and medical requirements.
The clinic will select a suitable medical professional and proceed to book the appointment. You will be notified of your booking details via email and you will be asked to click on a link to confirm your appointment date and time. This is important because it enables us to keep the doctors’ appointment calendars accurate and shows us the real availability for other customers who depend on our service.
If you are not able to receive an email, we will confirm the appointment by SMS or voice call.
Please remember that you have the right to consent or refuse consent to any proposed treatment, test or therapeutic course and you should discuss any questions or concerns directly with the medical professional.
11.5 PERSONAL DATA & THE MEDICAL CONCIERGE GROUP (TMCG) ACCOUNT
To set-up your account you will need to provide an email address and create a password (these are called your credentials). You are responsible for keeping your password confidential and for notifying us if your password has been compromised or stolen.
The Patient History Record is added to your electronic medical record. Once you have set-up your account, you will also be able to add any pertinent medical data to your electronic medical record.
Important – when you register as a customer and/or set-up your Rocket Health Clinic account to access your electronic medical record, you must provide true, correct, up-to-date and complete information. You also agree not to post, publish, transmit or communicate messages that might involve a criminal offence or that could be detrimental to the Company. If you provide information that is untrue, inaccurate, not current or incomplete, or the Company has reasonable grounds to suspect that the information you have provided is untrue, inaccurate, not current or incomplete, the Company has the right to suspect or terminate your account and refuse any and all current or future use of the Company services.
The data in your record may include:
- Personal data such as name, age, address and other contact details.
- Any clinically relevant information such as smoking, alcohol consumption and weight.
- Information about appointments made on your behalf such as date, time, location, name of medical professional and/or medical entity etc.
- Consultation notes which the medical professional takes during an appointment unless these are subject to professional privilege and the medical professional decides against disclosing them to the Company.
- Treatments received and/or ongoing treatments.
- Medicines taken and/or medicines that have been prescribed and any known reactions to medications in the past.
- Information about allergies and/or chronic conditions.
- Medical test results such as blood tests and x-rays.
The Company confirms that all personal data including sensitive personal data that it collects on you throughout the course of this Agreement, is kept strictly confidential and will not be sold, reused, loaned or otherwise disclosed unless clearly indicated when collected or in the case that you have given your explicit written consent.
You have the right to apply to see, or have a copy of your medical records and all other data the Company holds on you, at any time. This is called a Subject Access Request. A detailed explanation about your rights and how the Company safeguards your personal information is given in the Data protection and Privacy Policy.
The Company also offers you the possibility to subscribe to advantage packages at will, that offer the booking services at no cost or at a subsidized fee depending on the package. Additional costs may be incurred for other services like laboratory or pharmacy services.
By signing this agreement, you understand and accept that you will assume all the costs of all the medical care and health services you receive, and the Company will in no case cover any costs, charges or fees on your behalf.
If you are covered by an insurance policy which can intervene to cover some or all of your costs, you must inform Rocket Health clinic. It is also highly recommended that you inquire with your insurance prior to the appointment about the procedure for making a medical claim.
11.6 CANCELLATIONS
The Company will not be liable for any cancelled or otherwise unfulfilled appointments and the clinic has the right to charge a cancellation or no-show fee if the booking is not cancelled at least 24 hours prior to the appointment time. To cancel an appointment you must email [email protected]. Since no-shows disrupt the efficiency of our services and the availability of the medical professionals to the detriment of the other customers, we will resend you an appointment notification by email and/or SMS/ or voice call 24hrs before the scheduled appointment time. This message will also include a reminder of our cancellation procedure.
11.7 USER REPRESENTATIONS
By using the Company services, you represent and warrant that:
- All registration information you submit is truthful and accurate.
- You will maintain the accuracy of such information and promptly update the same to keep it true, accurate, current and complete.
- You will keep your password confidential and will be responsible for all use of your password and account.
- You are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use this website and the Company services; and
- Your use of the Company Services does not violate any applicable law or regulation.
11.8 CONTENT YOU PROVIDE
The Company may invite you to participate in blogs, message boards, online forums and other functionality and may provide you with the opportunity to create, submit, post, display, submit, transmit, distribute or broadcast content and materials (collectively “Contributions”) to the Company and/or to or via the website. Any contributions you transmit to the Company will be treated as non-confidential and non-proprietary.
You represent that your contribution will not violate or link to materials that violate any provision of this agreement or any applicable law or regulation.
By posting your contributions to the Website, you hereby authorize the Company and each end user a personal, unlimited, non-transferable, perpetual, non-exclusive, royalty free, fully paid license to access, download, print and otherwise use your contributions.
11.9 GUIDELINES FOR FEEDBACK AND REVIEWS
The Company encourages feedback because it ensures that the services offered by Rocket Health clinic are constantly improved upon. If you wish to share your views and experiences about the services offered by Rocket Health Clinic, simply complete the Review section in the schedule an appointment section of the website. We strongly suggest that you discuss any concerns relating to the medical services received, directly with the provider of the service at the clinic during your appointment.
The Company may accept, reject or remove reviews in its sole discretion. You must comply with the following criteria when posting reviews:
- Reviewers should have firsthand experience with the person/Company being reviewed.
- Reviews should not contain offensive language, profanity, abusive, racist, or hate language or discriminatory references.
- Reviewers should not be affiliated to competitors if posting negative reviews.
- Reviewers should not make any conclusions as to the legality of conduct.
- Reviewers may not post any false statements or organize any campaigns encouraging others to post positive or negative reviews.
Reviews are not endorsed by the Company and do not represent the views of the Company or of any affiliate or partner of the Company. The Company does not assume liability for any review or for any claims, liabilities or losses resulting from any review. By posting a review, the reviewer hereby grants to the Company a perpetual, non-exclusive, worldwide, royalty-free, fully paid, assignable license to reproduce, modify, translate, transmit by any means, display, or distribute all content relating to the review.
11.10 LIMITATIONS AND LIABILITY
The Company works as an independent healthcare providing facility however, in the provision of services it may cooperate with various medical professionals, clinics and hospitals to render its services to its customers. There is however no partnership, joint venture, employer/employee, principal and agent or any similar relationship between the clinic and the other health service providers. By signing this Agreement, you confirm that you shall hold harmless and indemnify the Company, its officers, directors, successors and employees from and against any and all liabilities, costs, damage expenses, and lawyers’ fees of any kind, character or nature resulting from or attributable to any and all acts and/or omissions committed by the medical professional, clinic or hospital in the course of providing his/her/its medical services to you, the Customer.
Moreover, under no circumstances shall the Company or any of its officers, directors, successors, employees, affiliates or third parties with whom it cooperates, be liable for any direct, indirect, incidental, special or consequential damages resulting from the use of or the inability to use the website and/or any of the Company’s services or for the cost of procurement of substitute services or resulting from unauthorized access to or alteration of your data. Notwithstanding anything to the contrary contained herein, the Company’s liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to the Company for the Company Services during the period of three (3) months prior to any cause of action arising.
11.11 COPYRIGHT
The content on the website and the trademarks, service marks and logos contained therein are owned by or licensed to the Company and are subject to copyrights and other intellectual property rights of Uganda and foreign laws and conventions. Company’s trademarks and other intellectual property in connection with any product or service may not be used, including as part of trademarks and or as part of any domain names, in connection with any product or service or in any manner that is likely to cause confusion or may not be copied, imitated or used, in whole or in part, without the written permission of the Company.
11.12 ELECTRONIC CONTRACTING
Your use of the Company services includes the ability to enter into agreements and/or enter to make transactions electronically. YOU ACKNOWLEDGE THAT YOUR ELECTRONIC SUBMISSIONS CONSTITUTE YOUR AGREEMENT AND INTENT TO BE BOUND BY ELECTRONIC SUBMISSIONS APPLIES TO ALL RECORDS RELATING TO ALL TRANSACTIONS YOU ENTER INTO RELATING TO THE COMPANY SERVICES, INCLUDING NOTICES OF CANCELLATION, POLICIES, CONTRACTS, AND APPLICATIONS. In order to access and retain your electronic records, you may be required to have certain hardware and software, which are your sole responsibility.
11.13 MISCELLANEOUS
This Agreement constitutes the entire agreement between you and the Company regarding the use of Company services. Failure on the part of the Company to exercise or enforce any of the provisions of this Agreement shall not operate as a waiver of such right or provision. This Agreement and your Account may not be assigned by you without the Company’s express written permission. The Company may assign any or all of its rights and obligations to others at any time.
Company shall not be responsible or liable for any loss, damage, delay or failure to act caused by any cause beyond the Company’s reasonable control.
If any provision or part of this Agreement is unlawful, void or unenforceable, that provision or part of the Agreement is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
There is no joint venture, partnership, employment or agency relationship created between you and the Company as a result of this Agreement or use of the website and Company services.
You hereby waive any and all defenses may have based on the electronic form of this Agreement and the lack of signing by the parties hereto to execute this Agreement.
11.14 INDEMNITY
You agree to defend, indemnify, and hold the Company, its subsidiaries, its affiliates and their respective officers, agents, partners and employees harmless from and against any loss, damage, claim or demand including reasonable attorneys’ fees and expenses made by any third party due to or arising out of your contributed content, use of the Company services and/or arising from a breach of this Agreement, and/or a breach of your representations and warranties, set forth above.
